Confidentiality
and Access to Privileged Information
The Employee Assistance Program is committed to
maintaining the privacy and confidentiality of those who
use our services. Information provided by the employee at
EAP appointments and the EAP record regarding the employee's
problem assessment, counseling and referral will be treated
as confidential. The employee's case file will not be released
to any third party without the employee's written consent
to disclose information.
Your confidentiality is limited only by what is dictated
by law. The law requires the EAP counselors to report any
suspected instances of abuse or neglect of minors to the
Illinois Department of Children and Family Services (DCFS).
Additionally, the Mental Health and Developmental Disabilities
Confidentiality Act requires us to warn any intended victim
when a client discloses an intent to cause physical harm
to a specific person. The Confidentiality Act also allows
for the EAP counselor to consult with other EAP staff or
the EAP supervisor for the purpose of direction and guidance.
The decision to participate in EAP services is VOLUNTARY,
even when supervisors refer employees. When the supervisor
refers an employee, the supervisor is only told the number
of visits.
No employee shall have his or her job security or
promotional opportunities jeopardized because of his or
her participation or failure to participate in the EAP.
Only work performance criteria and conduct, constitute the
basis for personnel actions.
